On April 6, 2023, Amazon froze WallProfit’s accounts, cutting off access to our funds and goods without explanation or legal basis, leaving us facing a barrier of corporate “instructions” from Amazon. What does this mean? It signifies that Amazon’s internal policies are placed above the law, and the rights of companies like ours are called into question.

Amazon’s actions represent a severe violation of the fundamental right to property, enshrined in Article 1 of Protocol No. 1 of the European Convention on Human Rights, which states, “Every natural or legal person is entitled to the peaceful enjoyment of their possessions. No one shall be deprived of their possessions except in the public interest and subject to the conditions provided for by law and by the general principles of international law.” It’s no coincidence that this right is the first article of the Convention, as property rights are essential in any modern lawful society.

Who Gave Amazon the Right to Place Its Rules Above the Law?

Despite this, Amazon chose to ignore legal standards, withholding WallProfit’s funds and products for over a year and a half based solely on its own “corporate instructions.” This blatant disregard for fundamental property rights sets a dangerous precedent where corporate interests take precedence over international law.

In a lawful state, the protection of private property is an unbreakable principle. The assumption that a corporation can seize assets by citing only internal “rules” is a threat to the foundations of legal order. However, Amazon seems to believe that its instructions should override the law, effectively creating a new “law” for everyone who does business on its platform.

How else can one explain that, despite numerous lawyer requests, police complaints, and public protests outside Amazon’s offices, Amazon has refused to return our assets for over a year and a half? The corporation remains indifferent to WallProfit’s right to its property and continues to place its internal “instructions” above the rule of law.

The Fight for Justice: Law Must Prevail Over Amazon’s “Instructions”

WallProfit will not tolerate Amazon’s corporate misconduct. We have sought justice through police authorities in Luxembourg and Estonia to hold Amazon accountable for these unlawful actions, and on October 18, 2024, we filed an official lawsuit in the Luxembourg Arbitration Court. This step is not only about reclaiming our assets but also about protecting the fundamental principles on which any lawful society stands.

What Are We Expecting from the Court?

Firstly, a reaffirmation that the law, not Amazon’s “instructions,” is supreme. We believe that the court will confirm that property rights cannot be limited by arbitrary corporate decisions. This will not only restore our access to assets but, if necessary, compel Amazon to align its practices with the law. Secondly, we hope that this legal ruling will set a precedent that protects other entrepreneurs from Amazon’s corporate overreach.

Today, we face serious questions about justice and the rule of law, where a massive corporation like Amazon dictates the rules, and small businesses are left effectively voiceless. Amazon would prefer its “instructions” to be perceived as law, but what happens when these “rules” begin to erode trust, become a source of profit through the withholding of client assets, and result in significant financial losses?

WallProfit Will Not Stop: Amazon Must Submit to the Law

We are prepared to see this matter through to the end. This is not only about reclaiming our funds but also about ensuring justice and the supremacy of the law. WallProfit demands not only compensation for our losses but also a thorough revision of Amazon’s corporate policies, which place company interests above the law. We insist that Amazon’s policies align with international law, respecting the sanctity of private property. No policy drafted behind corporate doors can or should replace the law.
